We are in a Constitutional crisis!

Why are we in a Constitutional crisis? Let me count some of the ways:

  • President Bush authorized illegal warrantless wiretaps
  • Vice President Cheney engaged in a conspiracy to “out” a CIA agent
  • Attorney General Gonzales has lied under oath and is engaged in obstruction of justice
  • Karl Rove violated the Hatch Act and politicized the Department of Justice
  • Bush, Cheney, Rove and Gonzales have conspired to undermine the balance of powers by ignoring Congressional subpoenas and circumventing judicial oversight mandated by law (e.g. FISA courts)

And this is probably just the tip of the iceberg!

The Constitutional solution to this crisis is impeachment.

Although Speaker Pelosi has taken impeachment “off the table,” other Democrats have taken the lead in calling for impeachment:

Hawai‘i Democrats believe that George W. Bush, Richard B. Cheney, Condoleeza Rice, Donald H. Rumsfeld and Alberto Gonzalez, as officers of the United States of America, have attempted to subvert the Constitution of the United States of America, place the Executive above the law and usurp the powers of the Congress, the Judiciary and those reserved to the people of the United States, through the commission of numerous high crimes and misdemeanors, including, but not limited to, lying to Congress and the American people about the need to invade Iraq, committing the United States to an undeclared war of aggression against Iraq in violation of the United States Constitution, the United Nations Charter, the Geneva Conventions, the Universal Declaration of Human Rights and the Nuremburg Charter, authorizing the use of torture in violation of those same instruments and using the National Security Agency to illegally spy on Americans. Hawai‘i Democrats support the impeachment and trial of said officers, their removal from office and their disqualification to hold any office of honor, trust or profit under the United States. . . . We call on our senators and representatives to do all they can to impeach President George Bush and Vice-President Richard Cheney and remove them from office as soon as possible.

  • Rep. Dennis Kucinich (D-OH 10) has proposed a resolution to impeach Vice President Cheney, H Res 333, which now has 18 co-sponsors, 3 of whom joined this month (August)!
  • Rep. Jay Inslee (D-WA 1) has proposed a resolution (H Res 589) directing the Committee on the Judiciary to investigate whether Alberto R. Gonzales, Attorney General of the United States, should be impeached for high crimes and misdemeanors. This bill now has 27 co-sponsors!

Please ask your Representative to co-sponsor and support these resolutions!

And it’s not just Democrats! Conservative Republican Bruce Fein has called for the impeachment of Vice President Dick Cheney. According to Fein, as publicized by Bill Moyers’ Journal, Cheney has committed eight offenses meriting impeachment.

  1. Due to scheduling conflicts, I could not join the PDH group when they met with Representative Hirono and Representative Abercrombie’s Chief of Staff, Amy Asselbaye, earlier this year. I did, however, speak to both of them individually on impeachment proceedings during meetings on another matter. Here is the essece of what I was able to ascertain from these meetings:

The Republican members of the House will vote as a block to support Bush under any circumstances, with few defections. Most of the moderate Republicans of years past, who would have conceivably joined the Democratic members, have either been replaced by conservatives or lost their seats in the last congressional elections. What we are dealing with is a “jihad.” Bush is treated as a messianic figure by the Republican church members (Yes, the Republicans are no longer a party but a religious organization). We have to work to increase the numbers of Democrats in the House before anything substantial can be accomplished. Does anyone here know the procedures for criminal prosecution of the President, Vice-President, Attorney General, etc, after their terms of office have ended?
